DISTANCE SALES AGREEMENT

2. SUBJECT AND SCOPE OF THE AGREEMENT

This Distance Sales Agreement is prepared within the scope of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.  

The subject of this Agreement is the purchase of digital embroidery files from the website www.embroiderydesignmachine.com by the Buyer. The rights and obligations of the Parties under this Agreement are determined according to the provisions of the Law and the Regulation.  

The Buyer declares and undertakes that by placing an order from the Website, they fully accept the terms of this Agreement.  

3. BASIC CHARACTERISTICS AND PRICE OF GOODS AND SERVICES

Product Information:  
- Product Code and Name  
- Seller Title  
- Quantity  
- Unit Price  
- Total Sales Amount  
- Total Amount Including VAT  

Payment Information:  
- Payment Method: Payment options specified on the Website  
- Interest Difference: Interest rates specified on the Website  
- Total Amount: The price announced on the website  

Delivery Information:  
- Products will be delivered as digital files.  
- There is no shipping fee, and the delivery is directly added to the "My Files" section.  
- For email deliveries, it is sufficient for the customer to confirm receipt of the email.  

4. PAYMENT AND DELIVERY TERMS

Payment Terms:  
Payments can be made using the payment methods specified on the website.  
Files will not be accessible for orders with incomplete payments.  

Delivery Method:  
- Digital products will be added to the "My Files" section in the Buyer's account panel after payment.  
- Alternatively, delivery can be made via email after payment.  
- If the Buyer does not report the non-delivery of the file within 5 days, it will be considered delivered and no further claims can be made.  

File Loss and Re-delivery:  
- The downloading and storage of digital files are the responsibility of the Buyer.  
- The Seller is not obliged to resend the file if it is lost or accidentally deleted.  

5. RIGHT OF WITHDRAWAL AND RETURN CONDITIONS

There is no right of withdrawal for digital products.  
Once payment is completed and the product becomes downloadable, returns or exchanges cannot be made.  
The Buyer may cancel the order only if it has not yet been approved.  

6. BUYER'S DECLARATIONS AND COMMITMENTS

The Buyer declares that they have thoroughly reviewed the product descriptions and prices before placing an order and that they accept these conditions.  
It is strictly prohibited to sell, share, or copy digital products to third parties.  
The purchased products are for personal use only and cannot be used for commercial purposes or distributed.  

7. SELLER'S DECLARATIONS AND COMMITMENTS

The Seller is responsible for delivering the ordered product completely and as specified.  
In case of force majeure (system errors, cyber-attacks, etc.) causing delivery delays, the Buyer will be informed within 15 days.  
If the product is to be delivered to a person other than the Buyer, the Seller is not responsible for non-acceptance by the recipient.  

8. INTELLECTUAL PROPERTY AND COPYRIGHT

The digital embroidery files purchased by the Buyer are the property of Embroidery Design Machine.  
Embroidery designs or patterns may continue to be sold on different platforms by the Seller even after the Buyer’s purchase.  
The Buyer cannot share, sell, or reproduce the purchased design with third parties.  
The purchased designs can only be used to produce personal or commercial products, but the sale of the design itself is strictly prohibited.  

9. RESOLUTION OF DISPUTES

The Buyer may directly report complaints about the purchased products to the Seller or through the Website.  
In the event of unresolved disputes between the Parties, Consumer Arbitration Committees and Consumer Courts shall be authorized.  
The Seller's records and electronic data are deemed as conclusive evidence under the Code of Civil Procedure.  

10. ENFORCEMENT AND ACCEPTANCE OF THE AGREEMENT

By placing an order, the Buyer is deemed to have electronically accepted this Agreement.  
The Agreement comes into effect on the date it is approved by the Buyer.
